JUH delegation meets with District Administration over Kutch demolitions, seeks legal review
New Delhi/Bhuj, June 30: A high-level delegation of the Jamiat Ulama-i-Hind (JUH), led by its General Secretary, Maulana Mohammad Hakeemuddin Qasmi, on Tuesday met Resident Additional Collector Parth Kotadia to raise concerns over the recent demolition of houses, mosques, dargahs and other structures in parts of the district.
The delegation urged the administration to ensure that all actions are carried out strictly in accordance with the Constitution, the directions of the Supreme Court, and the principles of natural justice. It questioned the legal basis of the demolition drives, stating that several of the affected localities are situated well away from the international border and that any action affecting private property or religious structures must follow the due process prescribed by law.
During the meeting, the delegation sought clarification regarding the demolition of houses and commercial establishments in Nana Varnora and called for an independent inquiry into allegations that the village sarpanchs signatures had been forged on certain official notices for demolition drive. It also sought the release of those arrested in connection with protests against the demolitions, including six minors, and urged the administration to provide rehabilitation and adequate compensation to affected families. The memorandum further called for strict compliance with constitutional safeguards and judicial directions in matters relating to mosques, dargahs, religious institutions and waqf properties, while emphasising that no demolition should be carried out without prior notice and an opportunity for the affected parties to be heard.
Resident Additional Collector Parth Kotadia heard the delegations submissions and assured its members that the issues raised would be placed before the competent authorities and examined in accordance with the law.
Prior to meeting the administration, the delegation visited Nana Varnora, Danara, Khavda and Toga to assess the situation on the ground. It interacted with affected families, local ulema and community representatives, assessed demolished structures and examined documents made available by local residents.
According to residents who met the delegation, 17 houses and 21 shops were demolished in Nana Varnora during the recent drive. The delegation also said that 25 persons, including six minors, had been arrested following protests. It further referred to allegations made by village sarpanch Abdul Latif Kever that his signatures had been forged on certain notices and called for an impartial investigation into the matter.
Representatives from Danara, Khavda and Toga informed the delegation that the mosque at Toga had been demolished after what they described as an extremely short notice period. They also referred to the earlier demolition of a mosque at Adipur (Kandla). JUH said it would examine the legal aspects of all such cases before initiating further legal proceedings.
As part of its response, the organisation also held consultations in Bhuj with senior advocates to formulate its legal strategy. On the directions of its president, Maulana Mahmood Asad Madani, a panel of lawyers had been constituted to examine all the cases and initiate appropriate legal proceedings wherever necessary.

नई दिल्ली/भुज, 30 जून: जमीयत उलेमा-ए-हिन्द के नाज़िम-ए-उमूमी मौलाना मोहम्मद हकीमुद्दीन क़ासमी के नेतृत्व में एक उच्चस्तरीय प्रतिनिधिमंडल ने आज भुज कलेक्टर कार्यालय में रेज़िडेंट एडिशनल कलेक्टर पार्थ कोटडिया से मुलाकात कर हालिया ध्वस्तीकरण की कार्रवाइयों पर गहरी चिंता और कड़ा विरोध दर्ज कराया। प्रतिनिधिमंडल ने मांग की कि सभी प्रशासनिक कार्रवाइयाँ सर्वोच्च न्यायालय के निर्देशों, संविधान तथा प्राकृतिक न्याय (Natural Justice) के सिद्धांतों के अनुरूप की जाएँ।
प्रतिनिधिमंडल ने एडिशनल कलेक्टर से पूछा कि जिन क्षेत्रों में ध्वस्तीकरण किया गया है वे अंतरराष्ट्रीय सीमा से काफी दूर स्थित हैं, ऐसे में इन कार्रवाइयों का कानूनी आधार क्या है। प्रतिनिधिमंडल ने कहा कि यदि कोई क्षेत्र सीमा से संबंधित भी हो, तब भी किसी नागरिक या धार्मिक स्थल के विरुद्ध कार्रवाई केवल कानून के दायरे में रहकर ही की जा सकती है और इसके लिए संवैधानिक प्रावधानों तथा न्यायालयों द्वारा निर्धारित प्रक्रियाओं का पूरी तरह पालन किया जाना चाहिए।
प्रतिनिधिमंडल ने प्रशासन के समक्ष कई महत्वपूर्ण मांगें रखीं, जिनमें नाना वरनोरा में मकानों और दुकानों के ध्वस्तीकरण का कानूनी आधार स्पष्ट करना, सरपंच के कथित फर्जी हस्ताक्षरों की निष्पक्ष जांच, नाबालिगों सहित गिरफ्तार लोगों की रिहाई, प्रभावित परिवारों का पुनर्वास एवं उचित मुआवज़ा, मस्जिदों, दरगाहों, धार्मिक संस्थानों और वक्फ़ संपत्तियों से संबंधित मामलों में संविधान एवं सर्वोच्च न्यायालय के निर्देशों का पूर्ण पालन तथा भविष्य में किसी भी ध्वस्तीकरण से पहले उचित नोटिस और सुनवाई का अवसर सुनिश्चित करना शामिल था।
रेज़िडेंट एडिशनल कलेक्टर पार्थ कोटडिया ने प्रतिनिधिमंडल द्वारा उठाए गए सभी मुद्दों को गंभीरता से सुना और आश्वासन दिया कि इन मामलों को संबंधित अधिकारियों के समक्ष रखा जाएगा तथा कानून के अनुसार उनका परीक्षण किया जाएगा।
प्रतिनिधिमंडल में हाजी मोहम्मद हारून (अध्यक्ष, जमीयत उलेमा मध्य प्रदेश), नूर मोहम्मद रायमा (सचिव, जमीयत उलेमा भुज), अतीकुर्रहमान कुरैशी (नाज़िम-ए-तंजीम, जमीयत उलेमा गुजरात), सलीम भाई रायमा (सचिव, जमीयत उलेमा अंजार), मौलाना अबुल हसन सिवानी (ऑर्गेनाइज़र, जमीयत उलेमा-ए-हिन्द), मुफ्ती अनीस (जमीयत चिल्ड्रन्स विलेज, अंजार), अब्दुल करीम बाफ़न, मोहम्मद अनीस कुरैशी तथा अन्य पदाधिकारी शामिल थे।
जमीयत उलेमा-ए-हिन्द ने इस पूरे प्रकरण में आगे की कानूनी रणनीति तय करने के लिए भुज में वरिष्ठ अधिवक्ताओं के साथ विस्तृत बैठक भी की। जमीयत उलेमा-ए-हिन्द के अध्यक्ष मौलाना महमूद असद मदनी के निर्देश पर अधिवक्ताओं का एक विशेष पैनल गठित किया गया है, जो सभी मामलों का अध्ययन कर आवश्यक कानूनी कार्रवाई करेगा।
प्रशासन से मुलाकात से पूर्व प्रतिनिधिमंडल ने कच्छ जिले के प्रभावित क्षेत्रों, विशेष रूप से नाना वरनोरा, दनारा, खावड़ा और तोगा का दौरा किया तथा प्रभावित परिवारों, स्थानीय उलेमा और सामाजिक प्रतिनिधियों से मिलकर हालात का जायज़ा लिया।
नाना वरनोरा में प्रतिनिधिमंडल ने ध्वस्त मकानों और दुकानों का निरीक्षण किया। स्थानीय लोगों के अनुसार हालिया कार्रवाई में 17 मकान और 21 दुकानें गिरा दी गईं, जबकि विरोध प्रदर्शन के बाद 25 लोगों को गिरफ्तार किया गया, जिनमें 6 नाबालिग भी शामिल हैं। प्रतिनिधिमंडल ने उपलब्ध दस्तावेज़ों और अभिलेखों का भी अध्ययन किया। स्थानीय सरपंच अब्दुल लतीफ़ केवर ने आरोप लगाया कि कुछ नोटिसों पर उनके फर्जी हस्ताक्षर किए गए हैं। प्रतिनिधिमंडल ने इस आरोप को गंभीर बताते हुए निष्पक्ष एवं स्वतंत्र जांच की मांग की।
दनारा, खावड़ा और तोगा में स्थानीय प्रतिनिधियों ने बताया कि तोगा की मस्जिद को अत्यंत कम समय की नोटिस के बाद ध्वस्त कर दिया गया, जबकि इससे पहले आदिपुर (कांडला) की एक मस्जिद भी ध्वस्तीकरण की कार्रवाई का शिकार हो चुकी है। प्रतिनिधिमंडल ने इन सभी मामलों के कानूनी पहलुओं का अध्ययन करते हुए प्रभावित लोगों को आश्वस्त किया कि जमीयत उलेमा-ए-हिन्द उन्हें अकेला नहीं छोड़ेगी और उनके संवैधानिक एवं कानूनी अधिकारों की रक्षा के लिए हर संभव कानूनी संघर्ष जारी रखेगी।
इस अवसर पर मौलाना मोहम्मद हकीमुद्दीन क़ासमी ने कहा कि कच्छ से जमीयत उलेमा-ए-हिन्द का संबंध कई दशकों पुराना है। उन्होंने कहा कि वर्ष 2001 के विनाशकारी भूकंप के समय जमीयत उलेमा-ए-हिन्द के वर्तमान अध्यक्ष मौलाना महमूद असद मदनी के नेतृत्व में सबसे पहले राहत दलों में जमीयत का काफिला यहां पहुंचा था। जमीयत ने प्रभावित परिवारों के लिए सैकड़ों मकानों का निर्माण कराया और जमीयत चिल्ड्रन्स विलेज जैसे स्थायी शैक्षिक एवं कल्याणकारी संस्थान स्थापित किए। उन्होंने कहा कि इसी ऐतिहासिक संबंध और मानवीय जिम्मेदारी के तहत जमीयत आज भी कच्छ के प्रभावि
