Jamiat delegation visits Kutch over mosque demolitions, weighs legal options
Seeks meeting with district administration; raises questions over alleged demolition without prior notice
New Delhi/Bhuj, June 29: A high-level delegation of Jamiat Ulama-i-Hind (JUH) on Monday visited parts of Gujarats Kutch district where mosques and other structures have recently been demolished, and said it was exploring legal remedies while seeking an explanation from the district administration over the alleged demolition of religious structures without prior notice.
The delegation, led by JUH General Secretary Maulana Mohammad Hakeemuddin Qasmi, visited the Juna Kandla Mosque in Gandhidham taluka, which was demolished earlier in the day. According to the organisation, the mosque had been entered in the official Waqf records since 1965 and was known locally for its distinctive architectural features.
During the visit, the delegation met members of the mosque committee, local residents and community representatives before holding consultations with senior advocates and legal experts on the legal options available.
Mohammad Samar, president of the mosque committee, alleged that the mosque was demolished on the morning of June 29 without any prior notice. He claimed that when members of the management sought an explanation from the authorities, they were prevented from approaching the site, removed by police personnel and threatened.
The delegation also stated that the Jama Masjid at Adipur had been demolished during the demolition drive.
According to information, 30 structures have so far been demolished, including 11 religious structures, 17 commercial establishments and two residential houses. The organisation further claimed that 25 youths who protested against the demolition drive had been arrested and sent to jail.
The delegation pointed out that Muslims constitute nearly 35% of the population in Bhuj taluka and around 25% of Kutch district. Given the size of the community, the region is home to hundreds of mosques, shrines and other religious institutions. It said the recent demolitions, created apprehension among residents who fear that additional places of worship could face similar action.
In a statement issued after the visit, the delegation said that where a mosque, shrine or any other religious institution is duly recorded in the Waqf register, any administrative action must be carried out in accordance with the law, the principles of natural justice and constitutional safeguards. It added that matters involving places of worship require strict adherence to due process and sensitivity in view of their religious significance.
The delegation also questioned the rationale behind invoking the areas proximity to the international border, contending that the affected localities are situated well away from the actual border and that the justification cited by the authorities requires legal and administrative scrutiny.
Assuring local residents of legal assistance, the delegation said it would pursue all available legal remedies. It added that it would seek a meeting with the Bhuj district administration before submitting a detailed fact-finding report to JUH president Maulana Mahmood Asad Madani, based on which the organisation would determine its future legal and organisational course of action.
The delegation comprised Maulana Mohammad Hakeemuddin Qasmi, JUH General Secretary; Haji Mohammad Haroon, president of Jamiat Ulama Madhya Pradesh; Atiqur Rahman Qureshi, Organising Secretary of Jamiat Ulama Gujarat; and Maulana Abul Hasan Palanpuri, Organiser of Jamiat Ulama-i-Hind. They were accompanied by local representatives Noor Mohammad Raima, Salimbhai Raima, Mufti Anees, Abdul Karim Bafan and Aneesbhai Qureshi.
Prior to the field visit, a meeting was held in Ahmedabad to review the legal aspects of the matter. It was also attended by Prof. Nisar Ahmad Ansari, State General Secretary of Jamiat Ulama Gujarat, and Advocate Tahir Hakim, among others.

नई दिल्ली/भुज, 29 जून: गुजरात के सीमावर्ती ज़िले कच्छ (भुज) में मस्जिदों, दरगाहों और अन्य धार्मिक संपत्तियों के ध्वस्तीकरण के बाद पूरे क्षेत्र में गहरी बेचैनी, चिंता और आक्रोश का माहौल है। इसी बीच ज़ख्मों पर नमक छिड़कते हुए आज गांधीधाम तहसील की ऐतिहासिक जूना कंडला मस्जिद को भी ध्वस्त कर दिया गया, जो अपनी विशिष्ट स्थापत्य शैली के कारण पूरे क्षेत्र की एक महत्वपूर्ण पहचान मानी जाती थी।
स्थिति की गंभीरता को देखते हुए जमीयत उलेमा-ए-हिन्द के अध्यक्ष मौलाना महमूद मदनी के निर्देश पर संगठन का एक उच्चस्तरीय प्रतिनिधिमंडल प्रभावित क्षेत्र के दौरे पर पहुँचा। प्रतिनिधिमंडल का नेतृत्व जमीयत उलेमा-ए-हिन्द के महासचिव मौलाना मोहम्मद हकीमुद्दीन क़ासमी कर रहे हैं। प्रतिनिधिमंडल में संगठन के वरिष्ठ पदाधिकारी, विधि विशेषज्ञ तथा राज्य स्तरीय पदाधिकारी भी शामिल हैं।
प्रतिनिधिमंडल ने सबसे पहले जूना कंडला मस्जिद के जिम्मेदारों एवं स्थानीय लोगों से मुलाकात कर घटनास्थल का निरीक्षण किया तथा वरिष्ठ अधिवक्ताओं और विधि विशेषज्ञों के साथ विस्तृत विचार-विमर्श किया, ताकि उपलब्ध कानूनी विकल्पों और आगे की रणनीति पर निर्णय लिया जा सके।
मस्जिद के अध्यक्ष मोहम्मद समार ने प्रतिनिधिमंडल को बताया कि 29 जून की सुबह बिना किसी पूर्व नोटिस के मस्जिद पर बुलडोज़र चला दिया गया। उन्होंने आरोप लगाया कि जब उन्होंने इसका विरोध किया और कारण पूछा तो पुलिस ने उन्हें बलपूर्वक वहाँ से हटा दिया तथा धमकियाँ भी दीं। उन्होंने बताया कि जूना कंडला मस्जिद वर्ष 1965 से सरकारी वक्फ रिकॉर्ड में दर्ज है तथा इसकी इमारत स्थापत्य कला की दृष्टि से भी विशेष महत्व रखती थी। इसी प्रकार आदीपुर की जामा मस्जिद को भी ध्वस्त कर दिया गया।
प्राप्त जानकारी के अनुसार अब तक 30 निर्माणों को ध्वस्त किया जा चुका है, जिनमें 11 धार्मिक स्थल, 17 व्यावसायिक प्रतिष्ठान और 2 आवासीय मकान शामिल हैं। विरोध करने वाले 25 युवकों को भी हिरासत में लेकर जेल भेजे जाने की सूचना है।
भुज तहसील में मुस्लिम आबादी लगभग 35 प्रतिशत तथा पूरे कच्छ ज़िले में लगभग 25 प्रतिशत है। इतनी बड़ी आबादी के कारण सीमावर्ती क्षेत्रों में सैकड़ों मस्जिदें, दरगाहें और अन्य धार्मिक स्थल स्थित हैं। इसके बावजूद यहाँ के मुसलमान राजनीतिक, सामाजिक और काफी हद तक आर्थिक रूप से भी हाशिए पर जीवन व्यतीत करने को विवश हैं। इसका एक स्पष्ट उदाहरण यह है कि भुज तहसील की 78 झुग्गी बस्तियों में से 63 केवल मुस्लिम आबादी वाली बस्तियाँ हैं। स्थानीय लोग सरल स्वभाव के हैं और अपनी इबादतगाहों को ध्वस्त होते देखकर गहरे दुख, सदमे और असहायता का अनुभव कर रहे हैं।
जमीयत उलेमा-ए-हिन्द के प्रतिनिधिमंडल ने अपने प्रारंभिक वक्तव्य में कहा कि यदि कोई मस्जिद, दरगाह अथवा अन्य धार्मिक स्थल विधिवत वक्फ रिकॉर्ड में दर्ज है, तो उसके संबंध में किसी भी प्रशासनिक कार्रवाई से पहले संबंधित कानूनों, प्राकृतिक न्याय के सिद्धांतों तथा संवैधानिक प्रावधानों का पूर्ण पालन किया जाना आवश्यक है। धार्मिक स्थलों से जुड़े मामले अत्यंत संवेदनशील होते हैं। सर्वोच्च न्यायालय भी अपने विभिन्न निर्णयों में प्रशासन को ऐसे मामलों में विधिसम्मत प्रक्रिया अपनाने का निर्देश दे चुका है, ताकि नागरिकों की धार्मिक भावनाएँ आहत न हों और कानून के शासन पर जनता का विश्वास बना रहे।
प्रतिनिधिमंडल ने यह भी कहा कि संबंधित क्षेत्र वास्तविक अंतरराष्ट्रीय सीमा से काफी दूर स्थित है। ऐसे में केवल “सीमावर्ती क्षेत्र” का हवाला देकर इस प्रकार की कार्रवाई किया जाना समझ से परे है और इसकी विधिक एवं प्रशासनिक समीक्षा आवश्यक है।
प्रतिनिधिमंडल ने स्थानीय मुस्लिम समाज को आश्वस्त किया कि इस अन्याय के विरुद्ध हर संभव कानूनी लड़ाई लड़ी जाएगी। प्रतिनिधिमंडल के सदस्यों ने बताया कि वे शीघ्र ही भुज जिला प्रशासन से भी मुलाकात करेंगे। प्रतिनिधिमंडल अपनी विस्तृत रिपोर्ट जमीयत उलेमा-ए-हिन्द के अध्यक्ष मौलाना महमूद असद मदनी को सौंपेगा, जिसके आधार पर आगे की कानूनी, संगठनात्मक एवं जनसंपर्क संबंधी कार्ययोजना की घोषणा की जाएगी।
प्रतिनिधिमंडल में जमीयत उलेमा-ए-हिन्द के महासचिव मौलाना मोहम्मद हकीमुद्दीन क़ासमी, जमीयत उलेमा मध्य प्रदेश के अध्यक्ष हाजी मोहम्मद हारून, जमीयत उलेमा गुजरात के नाज़िम-ए-तंजीम अतीकुर्रहमान कुरैशी तथा जमीयत उलेमा-ए-हिन्द के ऑर्गेनाइज़र मौलाना अबुल हसन पालनपुरी शामिल हैं। स्थानीय पदाधिकारियों में जमीयत उलेमा कच्छ के नूर मोहम्मद रायमा, सलीम भाई रायमा, मुफ्ती अनीस (चिल्ड्रन्स विलेज, अंजार), अब्दुल करीम बाफन (कमिश्नर, यूथ क्लब) तथा अनीस भाई कुरैशी भी उपस्थित रहे।
इससे पूर्व अहमदाबाद में एक महत्वपूर्ण बैठक आयोजित की गई, जिसमें जमीयत उलेमा गुजरात के नाज़िम-ए-आला प्रो. निसार अहमद अंसारी तथा एडवोकेट ताहिर हकीम ने भी भाग लिया और मामले के कानूनी पहलुओं पर विस्तार से विचार-विमर्श किया।
