Action Against 700-Year-Old Shrines Adjacent to King George’s Medical College Violation of Religious and Constitutional Rights: Jamiat
New Delhi, January 28: The President of Jamiat Ulama-i-Hind, Maulana Mahmood Madani, has expressed deep concern over the vandalism carried out within the precincts of the shrine of Hazrat Haji Harmain Shah (RA), located adjacent to King George’s Medical University, Lucknow, and the subsequent issuance of demolition notices against centuries-old shrines situated in the precincts of Hazrat Makhdoom Shah Meena (RA). He warned the college administration against violating the laws of the land governing waqf properties under the cover of misleading propaganda and demanded the immediate withdrawal of all such notices.
Explaining the historical background, Maulana Madani stated that the shrines adjoining King George’s Medical College are more than 700 years old, whereas the medical college itself was established in 1912. In this context, the attempt by certain sections of the media to suggest that “how such number of shrines are within a college campus” is not only factually incorrect but also deliberately misleading. He pointed out that at the time of the college’s establishment in 1912, the Revenue Department had clearly demarcated the shrine land separately from the university campus, which conclusively establishes its independent and permanent legal status.
Maulana Madani further said that the demolition carried out on April 26, 2025—under the supervision of Professor Dr. K. K. Singh—of the ablution area (wuzu khana), prayer space, and facilities meant for devotees within the boundaries of the nearly 700-year-old shrine of Hazrat Haji Harmain Shah (RA) was a unilateral and illegal act. No court order, approval from the Waqf Board, or consent of the mutawalli existed for such action. He observed that this demolition was executed amid a climate created by distorted media narratives rather than through any lawful process.
Emphasizing the legal position, Maulana Madani stated that the land in question is a duly registered waqf property under the Waqf Act, 1995, and stands recorded with the Sunni Waqf Board. Under the Waqf law, jurisdiction over disputes or actions concerning waqf properties lies exclusively with the competent court. No educational institution or administrative official has the authority to issue demolition notices or adopt coercive measures in this regard. Such actions, he said, are patently illegal.
Maulana Madani also expressed that it is to the Waqf Board to act proactively and decisively in such situations. He called for a special drive to systematically identify and protect ancient heritage sites, shrines, and places of worship, to ensure the restoration of demolished portions of the affected shrine, and to provide certified copies of legal documents to the mutawallis, so that similar incidents and conflicts can be effectively prevented in the future.

नई दिल्ली, 28 जनवरी:जमीयत उलेमा-ए-हिंद के अध्यक्ष मौलाना महमूद मदनी ने किंग जॉर्ज मेडिकल कॉलेज, लखनऊ द्वारा परिसर से सटे हज़रत हाजी हरमैन शाहؒ के आस्ताने में की गई तोड़फोड़ तथा अब हज़रत मखदूम शाह मीनाؒ के परिसर में स्थित पाँच सौ वर्ष से अधिक पुराने मज़ारों के विरुद्ध जारी किए गए ध्वस्तीकरण नोटिसों पर गहरी चिंता व्यक्त की है। उन्होंने कॉलेज प्रशासन को चेतावनी दी कि वह भ्रामक प्रचार के माध्यम से वक्फ संपत्तियों से संबंधित देश के कानूनों का उल्लंघन करने से बाज़ आए और तत्काल इन नोटिसों को वापस ले।
मौलाना मदनी ने ऐतिहासिक पृष्ठभूमि स्पष्ट करते हुए कहा कि किंग जॉर्ज मेडिकल कॉलेज से सटे ये मज़ार सात सौ वर्ष से भी अधिक पुराने हैं, जबकि कॉलेज की स्थापना वर्ष 1912 में हुई थी। ऐसी स्थिति में मीडिया के माध्यम से यह कहना कि कॉलेज परिसर में दरगाहों का क्या काम है, सरासर असत्य और भ्रम फैलाने वाला है। उन्होंने बताया कि कॉलेज की स्थापना के समय, वर्ष 1912 में ही, राजस्व विभाग ने दरगाह की भूमि को कॉलेज परिसर से अलग सीमांकन के माध्यम से स्पष्ट कर दिया था, जो उसकी स्थायी और स्वतंत्र कानूनी स्थिति का प्रमाण है।
मौलाना मदनी ने आगे कहा कि 26 अप्रैल 2025 को लगभग सात सौ वर्ष पुराने आस्ताना-ए-हज़रत हाजी हरमैन शाहؒ की सीमा में स्थित वुज़ूख़ाना, इबादतगाह तथा ज़ायरीनों की आवाजाही से संबंधित सुविधाओं को प्रोफेसर डॉ. के. के. सिंह की निगरानी में ध्वस्त किया जाना एकतरफ़ा और पूरी तरह गैर-कानूनी कार्रवाई थी। इस संबंध में न तो कोई न्यायालयी आदेश मौजूद था और न ही किसी प्रकार की वैधानिक अनुमति ली गई थी, बल्कि यह कार्रवाई मीडिया में फैलाए गए ग़लत नैरेटिव की आड़ में की गई।
मौलाना मदनी ने कहा कि यह स्पष्ट है कि संबंधित भूमि वक्फ अधिनियम, 1995 के अंतर्गत विधिवत वक्फ संपत्ति है और सुन्नी वक्फ बोर्ड में पंजीकृत है। वक्फ कानून के अनुसार वक्फ संपत्तियों से संबंधित किसी भी विवाद या कार्रवाई का अधिकार केवल सक्षम न्यायालय को प्राप्त है, न कि किसी शैक्षणिक संस्था या उसके किसी अधिकारी को। इसलिए इस प्रकार के नोटिस जारी करना और धमकीपूर्ण रवैया अपनाना पूरी तरह गैर-कानूनी है।
अंत में मौलाना मदनी ने कहा कि ऐसे मामलों में वक्फ बोर्ड की ज़िम्मेदारी है कि वह सक्रिय और प्रभावी भूमिका निभाए, प्राचीन धरोहरों, मज़ारों और धार्मिक स्थलों की संगठित पहचान के लिए एक विशेष अभियान चलाए, जिन हिस्सों को ध्वस्त किया गया है उनकी पुनर्बहाली सुनिश्चित करे तथा मुतवल्लियों को संबंधित कानूनी दस्तावेज़ों की प्रमाणित प्रतियां उपलब्ध कराए, ताकि भविष्य में इस तरह की घटनाओं और विवादों को प्रभावी रूप से रोका जा सके।
