Jamiat Welcomes passing of bill against hate speech in Karnataka Assembly
The Nation Must Unite in a Collective Fight Against Hate: Maulana Mahmood Madani
New Delhi, 19 December 2025:The President of Jamiat Ulama-i-Hind, Maulana Mahmood Madani, has welcomed the passage of a law by the Karnataka Assembly aimed at preventing hate speech and hate-based crimes. He said that the Supreme Court of India has repeatedly observed that a “climate of hate prevails in the country,” which poses a serious threat to social harmony, fraternity, and the democratic fabric of the nation. Against this backdrop, the initiative taken by the Karnataka government is a positive and significant step towards promoting social cohesion and upholding the constitutional values enshrined in the Constitution of India.
Maulana Madani stated that Jamiat Ulama-i-Hind has consistently and for a long time been demanding the enactment of an effective and comprehensive law to curb hate and hate-driven violence. In this regard, the Jamiat has undertaken several initiatives both within and outside the courts, and has also established a dedicated department to address and counter the growing menace of hate. He recalled that it was on the petition filed by Jamiat Ulama-i-Hind that the Supreme Court of India directed all states to ensure strict and effective implementation of the Tehseen Poonawalla Guidelines.
Referring to the April 2023 observations of the Supreme Court, Maulana Madani said that the Apex Court had categorically held that taking action against hate speech is a constitutional responsibility of the state machinery. The Court further emphasized that authorities should not wait for formal complaints, but must act suo motu to prevent and curb such offences. However, he expressed regret that despite these clear directions, most states have so far failed to take concrete and effective steps. In this context, the proactive initiative taken by the Karnataka government offers a much-needed ray of hope.
Maulana Madani stressed that the success of any law against hate and violence does not depend merely on its enactment, but rather on its fair, transparent, and non-discriminatory implementation. He underlined the need for a careful and comprehensive study of the law, and for removing any ambiguities in its definitions, so that no future government is able to misuse it as a tool against minorities or other vulnerable sections of society.
Reiterating his resolve, Maulana Mahmood Madani said that Jamiat Ulama-i-Hind will continue its principled struggle across the country for peace, fraternity, and the supremacy of the Constitution. He also appealed to all state governments to enact effective laws against hate speech and hate-based crimes in the light of the directions issued by the Supreme Court, so that those who spread hatred and poison social harmony can be held accountable.

नई दिल्ली, 19 दिसंबर 2025:जमीयत उलमा-ए-हिंद के अध्यक्ष मौलाना महमूद मदनी ने कर्नाटक विधानसभा द्वारा घृणास्पद भाषण (हेट स्पीच) और नफरत पर आधारित अपराधों की रोकथाम के लिए कानून की मंज़ूरी दिए जाने का स्वागत किया है। उन्होंने कहा कि सुप्रीम कोर्ट ऑफ इंडिया ने भी बार-बार यह टिप्पणी की है कि देश में “नफरत का माहौल” बना हुआ है, जो समाज की शांति, भाईचारे और देश के लोकतांत्रिक ढांचे को गंभीर रूप से नुकसान पहुँचा रहा है। ऐसे में कर्नाटक सरकार का यह कदम सामाजिक सद्भाव और भारतीय संविधान में निहित मूल्यों की रक्षा की दिशा में एक सकारात्मक और महत्वपूर्ण पहल है।
मौलाना मदनी ने कहा कि जमीयत उलमा-ए-हिंद लंबे समय से नफरत फैलाने वाली गतिविधियों के विरुद्ध प्रभावी कानून बनाने की मांग करती आ रही है। इस संबंध में जमीयत ने अदालत के भीतर और बाहर कई स्तरों पर प्रयास किए हैं। नफरत के प्रसार को रोकने के लिए जमीयत ने बाकायदा एक अलग विभाग भी स्थापित किया है। उन्होंने याद दिलाया कि जमीयत उलमा-ए-हिंद की याचिका पर ही सुप्रीम कोर्ट ने सभी राज्यों को तहसीन पूनावाला गाइडलाइंस के प्रभावी क्रियान्वयन का निर्देश दिया था।
उन्होंने आगे कहा कि अप्रैल 2023 में सर्वोच्च न्यायालय ने स्पष्ट रूप से यह कहा था कि घृणास्पद भाषण के विरुद्ध कार्रवाई करना राज्य मशीनरी की संवैधानिक जिम्मेदारी है और इसके लिए किसी औपचारिक शिकायत का इंतजार नहीं किया जाना चाहिए, बल्कि स्वतः संज्ञान लेकर कार्रवाई सुनिश्चित की जानी चाहिए। दुर्भाग्यवश, अधिकतर राज्यों ने अब तक इस दिशा में कोई ठोस कदम नहीं उठाया है। ऐसी स्थिति में कर्नाटक सरकार की यह पहल आशा की एक किरण है।
मौलाना मदनी ने इस बात पर भी जोर दिया कि नफरत और हिंसा के खिलाफ किसी भी कानून की सफलता केवल उसके अस्तित्व पर निर्भर नहीं करती, बल्कि उसके निष्पक्ष, पारदर्शी और गैर-भेदभावपूर्ण क्रियान्वयन पर निर्भर करती है। इसलिए आवश्यक है कि इस कानून का गहराई से अध्ययन किया जाए और इसकी परिभाषाओं में यदि कोई अस्पष्टता हो तो उसे दूर किया जाए, ताकि भविष्य में कोई भी सरकार इसका दुरुपयोग अल्पसंख्यकों या कमजोर वर्गों के खिलाफ हथियार के रूप में न कर सके।
मौलाना महमूद मदनी ने इस संकल्प को दोहराया कि जमीयत उलमा-ए-हिंद देश भर में शांति, भाईचारे और संविधान की सर्वोच्चता के लिए अपनी संघर्षपूर्ण भूमिका निभाती रहेगी। साथ ही उन्होंने सभी राज्य सरकारों से अपील की कि वे सुप्रीम कोर्ट के निर्देशों के अनुरूप घृणास्पद भाषण और नफरत पर आधारित अपराधों के खिलाफ प्रभावी कानून बनाएं, ताकि समाज में ज़हर घोलने वालों को जवाबदेह ठहराया जा सके।

نئی دہلی، 19 دسمبر 2025 :جمعیۃ علماء ہند کے صدر مولانا محمود اسعد مدنی نے کرناٹک اسمبلی کی جانب سے نفرت انگیز تقاریر اور نفرت پر مبنی جرائم کی روک تھام سے متعلق قانون کی منظوری کا خیرمقدم کیا ہے۔مولانا مدنی نے کہا کہ ملک میں’ نفرت کی فضا ‘ہے جیسا کہ سپریم کورٹ آف انڈیا نے اپنے تبصرے میں بارہا کہا ہے ۔ ایسی فضا جو پورے ملک اور سماج کے امن، بھائی چارے اور جمہوری ڈھانچے کو تباہ کررہی ہے۔ اس پس منظر میں کرناٹک حکومت کا یہ اقدام سماجی ہم آہنگی اور دستورِ ہند میں دی گئی اقدار کے تحفظ کی سمت ایک مثبت اوراہم پیش رفت ہے۔
مولانا مدنی نے مزید کہا کہ جمعیۃ علماء ہند طویل عرصے سے یہ مطالبہ کرتی آرہی ہے کہ نفرت انگیزی کے خلاف مؤثر قانون بنایاجائے۔ جمعیۃ علماء ہند نے عدالت اور عدالت سے باہر اس سلسلے میں متعدد اقدامات کیے ہیں بالخصوص اس کے سدباب کے لیے باضابطہ ایک شعبہ بھی قائم ہے ۔نیز جمعیۃ علماء ہند کی عرضی پر ہی سپریم کورٹ آف انڈیانے تمام ریاستوں کو ہدایت دی تھی کہ وہ تحسین پونہ والا گائیڈ لائن کےنفاذ کو یقینی بنائیں ۔اپریل 2023 میں عدالتِ عظمیٰ نے واضح طور پر کہا تھا کہ نفرت انگیز تقاریر کے خلاف کارروائی کرنا ریاستی مشینری کی آئینی ذمہ داری ہے، اس لیے وہ کسی کی طرف سے رسمی شکایت کا انتظار نہ کرے اور بلکہ خود کارروائی کو یقینی بنائے۔لیکن یہ افسوس کی بات ہے کہ زیادہ تر ریاستوں نے اس سلسلےمیں کوئی ٹھوس قدم نہیں اٹھایا ۔ ایسی صورت میں کرناٹک سرکار کی یہ پیش قدمی امید کی ایک کرن ظاہر ہوتی ہے ۔
مولانا مدنی نے اس امر پر زور دیا کہ نفرت اور تشدد کے خلاف کسی بھی قانون کی کامیابی محض اس کے وجود پر منحصر نہیں ہوتی، بلکہ اس کا اصل انحصار منصفانہ، شفاف اور غیر امتیازی نفاذ پر ہے۔اس لیے اس قانون کا مکمل مطالعہ کرکے اس کی تعریفات میں جو ابہام ہیں ، ان کا ازالہ کیا جانا ضروری ہے تاکہ مستقبل میں کوئی حکومت اسے اقلیت اور کمزور طبقات کے خلاف ہتھیار کے طور پر استعمال نہ کرے۔
مولانا مدنی نے اس عز م کا اظہار کیا کہ جمعیۃ علماء ہند ملک بھر میں امن، اخوت اور دستور کی بالادستی کے لیے اپنی جدوجہد جاری رکھے گی اور وہ تمام ریاستی حکومتوں سے اپیل کرتی ہے کہ وہ سپریم کورٹ کی ہدایات کی روشنی میں نفرت انگیز تقاریر اور نفرت پر مبنی جرائم کے خلاف مؤثر قانون بنائیں تا کہ ملک و سماج میں زہر پھیلانے والوں کو جوابدہ بنایا جاسکے۔
